Who Does the Builder's Sales Rep Work For?

They work for the builder

The on site sales team is paid to sell the builder’s homes at the builder’s price, on the builder’s contract. They can be great people. Their job is still to protect the builder.

Your first visit matters

Many builders want your agent with you, or registered, on your very first visit. If you sign the guest card alone, some builders will not let you add an agent later. Ask before you walk in.

A signed buyer agreement comes first

Since the 2024 NAR settlement, agent compensation is not set by law and is fully negotiable. Here in Nevada, I need a signed buyer brokerage agreement before I show you homes, and that includes model homes and new construction.

Builder co-op is common, not guaranteed

Many builders offer a buyer agent co-op, but it is not guaranteed. Policies vary by builder and can change, so we confirm it in writing before you commit to anything.

The contract is theirs

Builders use their own purchase contracts, not the standard Nevada purchase agreement most resale homes use. Deposits, timelines, and what happens if something is delayed are all spelled out in their terms.

Spec Home or Build From the Ground Up?

Builders sell two very different ways, and the timeline changes everything.

Spec homes

A spec home is usually standing inventory, or a home that is ready to close within about 30 days. The lot, floor plan, and finishes are already chosen. It works well if you need to move soon.

Building from the ground up

When you pick your lot and design your home, plan on about 6 to 9 months from contract to closing. You trade speed for choice.

The design center

Building from the ground up means a design center appointment, where you choose your options and upgrades. Expect to put down a design deposit at your design consultation. If you later cancel your purchase, you do not get that design upgrade deposit back.

What Contingencies Are in a Builder Contract?

Builder contracts are not the same as a resale contract, and each builder writes its own. These are the ones I make sure you understand before you sign.

The rescission period

Most builders give you a short rescission period, often about 5 days, where you can cancel for any reason and get your earnest money deposit back. This is what we would call your due diligence period.

The loan contingency

The time you have to secure your loan varies by builder. This one is very important to ask about up front.

The appraisal contingency

If the home does not appraise and you are using an FHA or VA loan, you may cancel and get your earnest money deposit back. With a conventional loan, many builder contracts do not guarantee your earnest money comes back if the appraisal comes in low.

Every builder contract is different. Read yours closely, and talk with a real estate attorney if you want a legal opinion on any term.

What Should You Ask Before You Sign a Builder Contract?

You do not have to figure this out alone, and you should not have to. These are the questions I walk through with every new construction buyer, before anything gets signed.

  1. Bring me in before your first visit

We sign your buyer brokerage agreement, and I register with the builder on your first visit. That keeps your options open and puts someone in your corner from day one.

  2. Compare the builder’s lender with your own

Builders often tie incentives to their preferred lender. That can be a great deal. I help you line it up against your own loan officer’s numbers so you know what you are actually getting.

  3. Separate what is included from what is an upgrade

The model is usually loaded with upgrades. We get the standard features list and set a design center budget together before your appointment, so nothing sneaks up on you.

  4. Ask about the lot premium

Corner lots, view lots, and bigger yards often cost more than the base price. I ask for the premium on every lot you like so you can compare them side by side.

  5. Ask about the HOA and any SID or LID

Some newer Las Vegas communities carry a special or local improvement district assessment on top of HOA dues. We find out how much it is and how long it lasts before you commit.

  6. Plan for higher property taxes

Property taxes on new construction are often higher than on a similar resale home. Your first bill may only reflect the land, and the 3% tax cap does not apply the first fiscal year. Many lenders estimate taxes on a new build at about 1% of the purchase price, which can change your monthly payment later on. Ask your loan officer how they are estimating it, and read how the cap works on my Las Vegas property tax cap page.

  7. Schedule your own inspections

A brand new home still benefits from an independent inspection, ideally before drywall and again before your final walkthrough. I coordinate the timing with the builder so it happens while they are still responsible for the fixes.

  8. Track every deadline in the contract

Rescission period, loan contingency, appraisal, design deposits. I keep the dates in front of you so nothing slips by while you are picking cabinets.

I am not here to talk you into a builder. I am here to make sure you compare them with the same questions, the same math, and the same eyes on the contract.

That means touring with you, comparing communities side by side, pushing for clarity on incentives and upgrades, and keeping an eye on your timeline from contract to closing.

Las Vegas New Construction FAQ

Do I need a Realtor to buy new construction in Las Vegas?

You are not required to have one, but the builder’s sales rep works for the builder. Your own agent can help you compare builders, review the builder contract, and track deadlines. Many builders want your agent registered on your first visit.

Who pays the buyer’s agent on a new build?

Since the 2024 NAR settlement, agent compensation is fully negotiable and not set by law. Many builders offer a buyer agent co-op, but it is not guaranteed. In Nevada, you sign a buyer brokerage agreement with your agent before touring homes, including new construction.

What is a spec home?

A spec home is a home the builder has already started or finished, usually standing inventory or ready to close within about 30 days. Building from the ground up, where you pick the lot and design the home, usually takes about 6 to 9 months.

Can I get my deposit back if I cancel a builder contract?

It depends on when and why you cancel. Most builders offer a short rescission period, often about 5 days, to cancel for any reason and get your earnest money back. Design center deposits are usually not refundable, and appraisal protections differ between FHA, VA, and conventional loans.

Are property taxes higher on new construction in Las Vegas?

They are often higher than on a similar resale home. The 3% tax cap does not apply the first fiscal year, and many lenders estimate taxes on a new build at about 1% of the purchase price, which can affect your monthly payment.

Where is new construction in Centennial Hills?

Most of it is in 89166 around Skye Canyon and Kyle Canyon, with more in 89131 and 89149. Builders selling there include Century Communities, KB Home, Tri Pointe Homes, Lennar, Toll Brothers, and Richmond American.

What new construction is in Tule Springs North Las Vegas?

The 89084 area around Tule Springs includes Sandstone at Tule Springs by KB Home and Heartland at Tule Springs and Serenity by D.R. Horton. Starting prices listed in October 2026 ranged from the high $290s into the $700s.

Should I get an inspection on a brand new home?

Yes. An independent inspection before drywall and again before your final walkthrough can catch issues while the builder is still responsible for fixing them.
